Abuse of Power

Abuse of power is a form of harassment that materializes when a person in a position of authority misuses their privileged status to deliberately jeopardize a subordinate’s job or well-being. This can notably take the form of criticizing the quality of their work in a manner that goes beyond reasonable exercise of the employer’s management rights.

Abuse of power must not be confused with the employer’s legitimate management rights, which permit guiding and correcting employees. This right notably permits the employer to reprimand and evaluate employees in order to improve their performance. Abuse of power only materializes when the management right is exercised in a unreasonable, unfair, or discriminatory manner.
